By using any of rc7's services, including virtual servers, dedicated servers, DNS, E3, etc., customers ("user", "you", or "their") agree to abide by the following Terms and Conditions of Service (TaCoS).
- Rights Reserved
We reserve the right to modify or discontinue any services that we provide, at any time.
- Account Responsibilities
Users are responsible for maintaining the confidentiality of their account credentials, including usernames, passwords, and any personal information. By signing up for service, you automatically agree and consent that we cannot be held liable for breaches of confidentiality arising from vulnerabilities outside of our scope. The "scope" of a particular service shall be considered to be the description as listed on our website at the time the user signs up for service, unless otherwise agreed upon by both parties. The "management" of a service by us shall not be deemed sufficient cause to consider a service as falling into our scope.
Users are responsible for providing accurate, current, and complete information during the registration process, and for keeping this information up to date. You can notify us of changes to your account information either via our web portal, email, text message, or phone. Users agree to notify us within a reasonable amount of time about any unauthorized use of their account or any other security breach.
- Use of Services
Users agree to use our services only for lawful purposes and in compliance with all applicable laws and regulations. Users may not use our services to transmit any content that is illegal under California law, contradicts or excludes the terms of our service providers, or violates intellectual property rights.
You may not engage in activities that interfere with the proper functioning of our services or our service providers' services, including but not limited to: spamming (bulk mail), distribution of malware, phishing, or hacking. Refunds will not be issued for violations of these terms, and we reserve the right to terminate users' service for any or all of these reasons, at any time.
If we should receive one or more notifications submitted in good faith about abuse originating from your service, we will promptly forward the notification to the primary email address registered to your rc7.net account, and you will be expected to resolve the complaint within 48 hours. Multiple complaints originating from different senders over a period of time not arising from the same incident shall be cause to terminate your account.
- Payment and Billing
All fees for services are due on the payment date specified in your account, and are non-refundable, except as required by California law. You agree to provide accurate and complete billing information, including a valid payment method. Late payments may result in suspension or termination of services.
- Service Availability
We strive to maintain 100% uptime for our services. However, it is not possible to guarantee uninterrupted or error-free service. Errors arising from a problem within our control will be addressed as soon as practicable. We make substantial effort to avoid loss of data, downtime, or interruptions, but cannot be held liable for unforeseen circumstances arising from, but not limited to, the same.
- Data Storage and Security
You retain ownership of all data stored on our servers, including files, content, and websites. We are not responsible for backing up or maintaining your data, and it is your responsibility to ensure that you have appropriate backups.
While we implement security measures to protect your data, we do not guarantee absolute security and are not liable for data breaches or losses resulting from third-party actions.
- Termination of Services
We may suspend or terminate your account if we believe you have violated these Terms of Service. Upon termination, you may lose access to your data and account information. You can terminate your services at any time by contacting us, but no refunds will be issued for any unused portion of the service.
- Limitation of Liability
In no event shall we be held liable for any indirect, incidental, or consequential damages, including but not limited to loss of data, revenue, or profits, resulting from your use of our services.
- Indemnification
You agree to indemnify and hold us harmless from any claims, damages, or expenses (including legal fees) arising from your use of our services, including any breach of these Terms of Service.
- Modifications to the Terms
We reserve the right to modify these Terms of Service at any time. Any changes will be posted on this page, and the "Last Updated" date will be revised accordingly. Your continued use of our services after any changes constitutes your acceptance of the updated Terms of Service.
- Governing Law
These Terms and Conditions of Service will be governed by and construed in accordance with the laws of California. Any legal action arising out of or relating to these terms shall be brought in the courts located in Los Angeles county.
